How can I ensure EU Digital Services Act Compliance for my White-Label App?

As you prepare to launch your WLA for your community, it’s crucial to ensure compliance with the European Union’s Digital Services Act (DSA), regardless of your region. Non-compliance can result in your app being removed from the App Store in EU regions, potentially affecting your business operations.

As your WLA is made available all over the world, we require all clients to adhere to the EU Digital Services Act regardless of your location.

Why Compliance Matters

The EU Digital Services Act requires all digital services, including mobile apps, to adhere to specific regulations if they operate within the EU. This ensures transparency and safety for users and service providers. Failing to comply can lead to significant consequences, including app removal by major platforms like Apple's App Store.

Steps to Ensure Compliance

  1. Identify Your Status Under the DSA

    • Trader vs. Non-Trader: When setting up your app, you must declare whether you are a trader under the DSA. Even if you do not primarily distribute in the EU, selecting "I'm not a trader under the DSA or I don't plan to distribute in the EU" can lead to future issues.

  2. Set Up as a Trader Under the DSA

    • Why It’s Important: By selecting "I'm a trader under the DSA," you ensure that your app complies with EU regulations. This selection helps avoid potential removal from the App Store in the EU region.

    • How to Do It: Follow this online guide from Apple to accurately declare your status as a trader under the DSA.

Potential Risks of Non-Compliance

  • App Removal from the EU Region: If you choose not to comply, we may have to remove your app from all European regions. This means some of your members might not find the app on the App Store.

  • App Takedown by Apple: If your app remains available in the EU without proper compliance, it risks being taken down by Apple for violating their policies. Should this happen, we are not responsible for the work required to restore your app.

By following these guidelines, you can ensure that your white-label app remains compliant and accessible to all your members in the EU.
